Event Terms & Conditions

Summary

These are the Terms and Conditions (hereafter: T&Cs) of Conversion Partners SL, a company incorporated under Spanish law, registered at the Spanish Trade Register, with registered office at C/ Las Tejas 8, 04007 Almería, Spain and with enterprise number ESB04829644. (hereafter: Talent Business Club).

These are the Terms and Conditions (hereafter: T&Cs) of Conversion Partners SL, a company incorporated under Spanish law, registered at the Spanish Trade Register, with registered office at C/ Las Tejas 8, 04007 Almería, Spain and with enterprise number ESB04829644. (hereafter: Talent Business Club).

Applicability These T&Cs are applicable to the Talent Business Awards (hereafter: “Awards”), organised by Talent Business Club and apply to each Candidate (i.e. an agency who submits its file to participate in one of the categories of the Awards); Ticket holder (i.e. an agency or a person who buys a ticket to attend the Awards ) and Sponsor (i.e. a company who is a sponsor to the Awards). (Hereinafter collectively referred to as “Customer”).

Tickets Everyone with an interest in the Recruitment and Staffing Agency sector in Belgium can buy a ticket for The Talent Business Awards Ceremony. Tickets are for sale via our Website.

We offer payment options including credit card and debit card.

Bank transfer payments are available upon request. If the request is accepted, the payment can be made to the following account number: IBAN ES5001821809010201673052 – BIC BBVAESMM. In case of payment by bank transfer, we will wait to send you the tickets until we receive the full amount of the order.

All tickets must be received by Talent Business Club on 7th of November 2024.

All tickets are personal and cannot be transferred unless this request is sent to Talent Business Club at least 14 days prior to the Awards. Cancellations will not be accepted.

Code of Conduct We want all Customers to feel welcome and safe at the Awards which is why we have a zero-tolerance approach to any behaviour that does not meet our expectations. Our events are professional settings, and we expect all attendee conduct to reflect this – for the protection of our team, our members and the reputation of the industry.

When you attend the Awards you have the right to expect to be treated fairly and with respect, in an environment which is free from harassment, including sexual harassment, bullying and all forms of unacceptable behaviour.

Harassment includes offensive verbal comments related to gender, age, sexual orientation, disability, physical appearance, body size, race, religion, sexual images in public spaces, deliberate intimidation, stalking, following, harassing photography or recording, sustained disruption of talks or other event content, and unwelcome sexual attention.

If an attendee engages in harassing behaviour, Talent Business Club may take any action they deem appropriate, including warning the offender or expulsion from the Awards.

If you are being harassed, notice that someone else is being harassed, or have any other concerns, please contact a member of Business Talent Club staff immediately.

Sponsors should not use sexualized images, activities, or other material in promoting their organisation or in communication with attendees. Sponsors staff (including volunteers) should not use sexualized clothing/uniforms/costumes, or otherwise create a sexualized environment.

During the Awards, you must:

behave in a way as to create a safe and supportive environment; comply with the instructions of the moderator and any Business Talent Club staff; comply with all applicable laws.

Nomination Eligibility Any company active in the recruiting or staffing field in Belgium is welcome to submit a nomination. Your business has to be in a good financial standing. Only submissions entered and paid before the deadline 15 August, in English will be considered for evaluation. Financial data and any provided data should be for FY 2023.

Selection Process The selection process is as follows: Candidates can submit their nomination up until 15 August 2024, by filling out the form accessible by using the following URL: https://talentbusiness.awardsplatform.com/ and paying the applicable submission fee (it includes a free ticket to the awards ceremony and gala dinner).

A professional jury consisting of different experienced people working in the HR and Recruitment field will evaluate all candidates and their application based on the following criteria: Performance: Demonstrated consistent growth, outstanding client satisfaction, and exceptional service delivery in the recruitment and staffing sector. Employer Brand: Strength of the company’s employer brand, reflected through employee satisfaction, talent attraction, and retention strategies. Sustainability: Commitment to sustainable practices within business operations, showcasing initiatives that reduce environmental impact and promote corporate social responsibility. Diversity, Equity, and Inclusion (DEI): Implementation of robust DEI policies, fostering an inclusive workplace culture and ensuring equitable opportunities for all employees. Innovation: Adoption of cutting-edge solutions and creative approaches in recruitment processes, demonstrating leadership in industry advancements. Financial Health: Strong financial performance and growth, highlighting the company’s economic impact and stability. Use of Technology: Effective utilisation of technology to enhance recruitment and staffing services, improve operational efficiency, and provide superior client and candidate experiences.

All applications should refer to evidence from the period January 2023 to June 2024 only. Financial evidence can be provided for the full annual year Jan – Dec 2023. Evidence provided outside of these dates will not be evaluated as part of the selection process.

The jury reserves the right to re-categorise candidates if they think another category would be more suitable.

The jury will assess all applications based on the aforementioned criteria and decide which candidates are most eligible in the category for which they applied.

Categories The Candidate can submit its nomination in the following categories: Talent Business of the Year as the main category, and in the following subcategories:

Newcomer of the Year; Project Staffing Agency of the year; Recruitment Agency of the year; All-round Talent Business of the year; Temp Staffing Agency of the year; Diversity, Equity and Inclusion (DEI) Initiative of the year; Talent Business Innovation of the year; Best Talent Business to work for of the year, Agency Recruiter of the Year

Candidates can apply for one or more categories.

The decision of the jury is binding and there is no possibility to appeal.

Submission Fee All Candidates must pay a Submission Fee in order to submit their application for the Awards. The Submission Fee must be fully paid before 15 August 2024 for submitting your nomination as outlined in article 4.2. Submissions without corresponding payment will not be taken into consideration by the jury. A voucher for a free ticket for the gala event is included in the submission fee.

Awards The winners of the Awards will be announced during the Talent Business Awards Ceremony which will be held on 21 November 2024 at the Tangla Hotel in Brussels (Belgium). More information can be found on the Website.

The winners of the Awards will not receive any financial reward for winning one or more awards.

4.6. Publication By submitting your file to participate in the Awards, you grant the right to Talent Business Club to publish your name, biography, photographs,…and any other information which you provided, in our online and offline communication as promotion for the Awards.

Audio/visual material By participating in or to the Awards as a candidate, you grant the Talent Business Club the right to use your name, title, photograph and biography for such purposes. By participating in or to the Awards as an attendee or candidate, you understand and accept that Talent Business Club may take Audio/visual material at the Awards for the purpose of promoting its future events in online and offline publications. If you don’t wish to be featured in our audio/visual materials, please contact us info@talentbusiness.club. You acknowledge the Talent Business Club’s right to crop, splice, treat and edit any audio/visual material taken of you at the Club’s sole discretion and waive the right to inspect or approve the finished product, now and in the future. The Talent Business Club represents that it shall act in good faith and not use or edit the audio/visual material in a way which would negatively portray you, or contrary to your opinion as made known during or in relation to the In case you are acting as a speaker or if you are being interviewed at the Awards, you agree and accept: Not to invoke your rights in respect of applicable copyright (such as moral rights, personality rights or portrait rights); That any goodwill generated from your participation as speaker or interviewee will injure to the benefit of the Talent Business Club; That the Talent Business Club nor the speaker or interviewee (nor the organisation they represent): – shall receive any compensation or benefit (in cash or kind) for any of the above; – dispose over a right of access to, or (except upon prior explicit and reasonable request) approval of the audio/visual material, and speaker nor the interviewee shall not unreasonably object to the use of (excerpts from) the (edited) audio/visual material by or on behalf of the Talent Business Club in as far as in compliance to this document.

Sponsorship We have different sponsorship packages available which can be consulted on our Website.

The sponsorship packages will be invoiced before the Awards take place and must be fully paid within the payment term as defined in article 6 and/or before the Awards take place at the latest.

The Sponsor declares that he is the owner or rights holder of the intellectual property rights on the marketing materials which he provides to Talent Business Club for inclusion in the Awards communication. The Sponsor will indemnify and hold Talent Business Club harmless for any third party claim relating to the marketing materials which have been provided by the Sponsors.

Invoices and payments All invoices are payable within 14 days of the invoice date to the following bank account number: IBAN: ES5001821809010201673052 – BIC BBVAESMM and with the order number as reference.

Non-payment of an invoice on the due date shall, by operation of law and without prior notice of default, give rise to interest of 1% per month commenced and to additional compensation of 10% of the invoice with a minimum of 75 EUR, without prejudice to legal and other costs and damages. In the event of (partial) non-payment of even one invoice, all outstanding, even non-due amounts, shall become immediately due and payable.

Any protests to invoices must be made in writing, within five (5) calendar days of receipt, stating the reasons for the complaint.

Intellectual Property The intellectual property rights to our ideas, concepts, developments, programs, publications, Website, Awards communication and any other work belong exclusively to us. The Customer shall notify us without delay of any infringement by third parties of our intellectual property rights of which he is aware.

When you submit artwork at or for the Awards as a Sponsor or speaker, present content at the Awards, or upload or link any material (including but not limited to images, text, documents, and/or video files) to the website related to or during the Awards, you declare and warrant that you have obtained the necessary permissions under copyright, trademark, trade secret, or other applicable law for the use of such material. You further represent that such material is not likely to defame any party and does not invade the privacy of any person.

You agree to defend, indemnify, and hold harmless Talent Business Club, its affiliates, and their respective directors, employees, and agents (including, but not limited to its publishing partner or any agent acting on its behalf) from and against any and all claims, damages, obligations, losses, liabilities, costs, or debts, and expenses (including reasonable attorneys’ fees) resulting from your breach of the obligations set forth in this clause.

Liability and insurance We shall not be liable for any direct or indirect damages for which we have not expressly defined our liability in these T&Cs.

With respect to services provided by third party suppliers, we do not accept any liability beyond or different from the liability that the third party suppliers are willing to accept for their products or services.

We shall never be liable for any indirect and/or any consequential damages such as lost sales or profits, increase in operational costs, loss of clientele by the Customer or third parties in relation to the Customer. In any case, our total liability will always be limited to direct damages and will never exceed the price or fee the Customer paid to us for the services that directly gave rise to the claim, with a maximum of 10.000EUR.

Data protection

Conversion Partners SL, a company incorporated under Spanish law, with trade name “Talent Business Club” registered at the Spanish Trade Register, with registered office at C/ Las Tejas 8, 04007 Almería, Spain, with enterprise number ESB04829644 is the Controller who will process the Customer’s personal data in accordance with the Privacy Policy available through the following link: talentbusinessawards.com/privacypolicy.

In case the candidate to the Awards shares personal data in its submission file (e.g. as a reference of a customer), the candidate ensures that this transfer of personal data is compliant with the GDPR.

Miscellaneous These T&Cs, together with any special conditions contained in our offer, constitute the entire agreement between the Customer and us, with respect to the subject matter contained herein.

If one or more provisions of these T&Cs should at any time be wholly or partially illegal, void or for any other reason unenforceable, this clause shall be deemed severable from these General Terms and Conditions and shall not affect the validity and enforceability of the remaining provisions.

Talent Business Club is not responsible for delays or failures to perform its responsibilities under these T&Cs due to causes beyond its reasonable control, including but not limited to acts of government, floods, fires, earthquakes, tornados, civil unrest, acts of terror, labor disputes, internet service provider or hosting facility failures, denial of service threats, or any other causes which are not attributable to Talent Business Club; provided however, that Talent Business Club will promptly resume performance as soon as reasonably practical.

Talent Business Club reserves the right to cancel the Awards at any time. In this case Talent Business Club will only refund the fees paid by the Customer to Talent Business Club and no other costs or expenses made by the Customer (e.g. hotel bookings,…).

Applicable law and competent court Belgian law shall apply to all disputes relating to or arising from our offers and/or agreements.

The parties agree to attempt in good faith and without delay to resolve any disputes or claims arising out of or in connection with these T&Cs or offer as quickly as possible through negotiation between them. If no resolution is reached within thirty (30) days of the plaintiff notifying the other party of the dispute, either party may bring the matter before the courts of the judicial district of Leuven, which shall have exclusive jurisdiction.

What are the purposes and legal basis for processing?

We process your personal data to respond to your request based on your consent to process personal data.

We process your personal data to enroll you as a member or sponsor of the Talent Business Club, to allow you to participate in our events and to issue an invoice based on the execution of the agreement between us.

We process your personal data as an Award candidate to assess your application and to issue an invoice based on the execution of an agreement between us.

We process your personal data as an Award attendee to send you the ticket and to issue an invoice based on the execution of an agreement between us.

We process your personal data to manage our accounting based on our legal obligation.

You are not required to send your personal data, but you must understand that providing certain services may be impossible if you refuse processing.

The personal data we process may be used for direct marketing when you have given your consent.

How do we secure your personal data?

We have taken sufficient technical and organisational measures to ensure secure processing of your personal data. These measures correspond to the nature of the personal data and are proportionate to the potential severity of the risk. The risk of accidental or unauthorised destruction, loss, alteration or access and any other unauthorised processing of the data has been minimised.

Unfortunately, no risk can be completely avoided. If unauthorised access is gained to our IT systems, we will immediately take all possible measures to minimise damage to and/or theft of the data and inform the parties involved.

We will not sell, rent, distribute or otherwise make your personal data commercially available to third parties, except as described in this Privacy Policy, or based on a legal obligation or in case of your prior consent.

In the event that we reorganise, transfer, cease to operate all or part of our business, or if we become insolvent, this may involve transferring your information to new entities or third parties that take over all or part of our business. Duration of processing?

The personal data will be kept and processed by us for a period necessary in function of the purposes of the processing and in function of the relationship between you and us.

We retain members, sponsors, award candidates and attendees’ data for up to 5 years after the termination of the agreement.

Your rights With respect to your personal data, you also have a number of rights:

Right of access and inspection. You have the right to access the personal data we have collected about you. This means that you can ask whether we collect personal data about you, what data it is, what we process it for and why, as well as with which categories of third parties we may share it.

In doing so, we have 30 days to process and respond to your inquiry.

Right of rectification, deletion and restriction. You have the right to have your personal data that is incomplete, incorrect, outdated or inappropriate removed or amended. To do this, you can contact us. We will then correct or delete the information within the time limits set by law. We ask you to actively report changes in your personal data yourself so that we can keep your data up-to-date.

Right to oppose the processing of your data for direct marketing. You have the right, without giving any reason, to oppose the processing of your personal data for direct marketing purposes.

Right of free data transfer. You have the right to obtain and/or transfer to other controllers your personal data processed by us in structured, common and machine-readable form.

Right to withdraw consent. To the extent the processing is based on your prior consent, you always have the right to withdraw that consent.

Description

The personal data will be kept and processed by us for a period necessary in function of the purposes of the processing and in function of the relationship between you and us. We retain members, sponsors, award candidates and attendees’ data for up to 5 years after the termination of the agreement.
