Welcome to Hong Kong Fintech Week 2020 (the "Event")! We hope you enjoy the Event.

The below terms and conditions (these "Terms") apply to the purchase of your ticket to, and your attendance at, the Event, physically and/or digitally (your ticket being the "Ticket").

By purchasing your ticket to and/or attending the Event, you agree to the below terms and conditions (these "Terms") between you and Finnovasia Limited ("we", "our" or "us"). If you do not agree to these Terms, please do not purchase the Ticket.

1. THE EVENT

The Event will be held digitally between 2 November 2020 to 6 November 2020, attendees can access at a designated online website/platform/application(the “Virtual Event”). Further details regarding the Event, including the proposed agenda, program and location(s) of the Event on each day, are set out at https://www.fintechweek.hk.

2. CHANGES TO THESE TERMS AND THE EVENT

We may amend these Terms and any Event details at any time – including by adding to, deleting or changing provisions to these Terms. If we do so, we will notify you by changing the Terms on this webpage. In addition, if such changes are (in our opinion) reasonably material, we will give you reasonable notice prior to such changes taking effect.

3. CHANGES TO OR CANCELLATION/SUSPENSION/POSTPONEMENT OF THE EVENT

3.1 We may, at any time and for any reason (but acting reasonably): (a) make alterations to the programme, agenda, speakers, venue, dates, and timings of the Event; and/or (b) cancel, suspend or postpone the whole or any part of the Event.

3.2 Where we make any such changes and if such changes are (in our opinion) reasonably material, we will give you reasonable notice prior to such changes taking effect. We will also promptly update our website to reflect any such changes.

3.3 Your Ticket grants you access to the Event and not for any specific activities or speakers.

4. YOUR TICKET AND THE EVENT

4.1 To attend the Event, you must hold a valid Ticket.

4.2 Your registration for and Ticket to the Event is only confirmed upon our receipt of your payment. All fees for the Tickets are payable in U.S. Dollars.

For Virtual Event, all payment is non-refundable and all passes are non-transferrable.

4.3 By attending the Virtual Event, you acknowledge and agree that you choose to participate in a designated third party live streaming website/platform/application, and will be subjected to third party terms and conditions. We are not responsible or liable to these third party sites, and you should review any terms and conditions when entering these third party sites.

4.4 The login representing the Ticket to the Event is for your personal and non-commercial use only which may not be shared with individuals besides yourself. For the duration of the Virtual Event we grant you a limited, non-exclusive, non-transferable right to access the Virtual Event and view the content. Except for this, no right, title or interest shall be transferred to you.

4.5 Access to the Event requires compatible devices, and certain software (including third party software) may be required or may need updates, and your view of the Virtual Event may be affected by the performance of these elements. You must have a high speed internet connection in order to access the Virtual Event. When accessing the Virtual Event through a mobile network, your network or roaming network will apply fees for data usage.

4.6 We may prohibit any person from attending the Event for any reason (acting reasonably) and we shall not be liable to any refund or compensation.

5. INTELLECTUAL PROPERTY RIGHTS

5.1 All rights to the Event belong to us, including any commercial rights and intellectual property rights arising from or in relation to the Event. Nothing in these Terms will act to license or transfer any rights of either party, except as expressly specified.

5.2 You are prohibited to photograph or video record any part of the Event for any use (including but not limited to any person or commercial purpose or use).

5.3 The Event may be filmed and items used for internet streaming. By attending the Event, you agree to:

a) grant us a perpetual, royalty free, worldwide licence to use your actual or simulated likeness in connection with the production, exhibition, advertising or exploitation of any film, video and/or audio recording of the Event (or any part of it), in any media (e.g. in future marketing materials). If you have any concerns about this, please notify us prior to attending the Event; and

b) being filmed by police or security staff for the purpose of ensuring public security at the Event and preventing crime.

6. BADGE SCANNING

6.1 You may be asked to share your personal information at the virtual exhibition booths or virtual session throughout the Event. Such sharing of your personal information is optional.

6.2 When your personal information is shared at the Event to an exhibitor and/or a sponsor, you agree to receive communications from that entity. Your personal data will be treated in accordance with that entity's privacy policy, and you may unsubscribe from such communications by contacting them directly.

7. DATA PRIVACY

7.1 By registering for the Event, you agree that your personal information as stated in the registration form and provided by you during the Event may be collected, used and disclosed by us (including our partners and authorised agents) for the purpose of the Event, including the facilitating and processing of payment and for business matching.

7.2 All Ticket holders will automatically be part of the Event app, your profile (your Ticket holding name, company and title) will be discoverable and visible in the app to the other Event attendees. If you wish to be excluded, you can make adjustments within the Event app.

7.3 We will always respect your privacy, and treat your personal data in accordance with: (a) Our privacy policy at https://www.fintechweek.hk/privacy-policy; and (b) Hong Kong data privacy laws.

8. LIABILITY

8.1 We will not be liable for any loss, damage, cost or expense arising in any manner, except:

(a) for any death or personal injury caused by our negligent act or omission; and

(b) to the extent required otherwise by applicable laws.

8.2 We are not liable for any loss arising from any cancellation or postponement of the Event for any reason, including where such cancellation or postponement is due to reasons outside of our control.

8.3 Views expressed by all speakers at the Event are their own. We are not liable for any advice given or views expressed by any speakers or in any materials provided to attendees.

9. PROHIBITED MATERIAL AND BEHAVIOUR

9.1 We prohibit the following from the Event:

(a) any political materials;

(b) any unauthorised materials for trading (including any goods or items using unauthorised event logos or brands); and

(c) any other item which (in our opinion) interferes with the safe or effective operation of the Event.

9.2 We prohibit the following behaviour at the Event:

(a) unauthorised professional photography or use of professional recording equipment and zoom lenses, audio visual or cinematographic devices;

(b) unauthorised merchandising

(c) harassment which includes verbal comments that reinforce social structures of domination related to gender, gender identity and expression, sexual orientation, disability, physical appearance, body size, race, age, religion, sexual images in public spaces, deliberate intimidation, stalking, following, harassing photography or recording, sustained disruption of talks or other events, inappropriate physical contact, and unwelcome sexual attention; or

(d) any other act which (in our opinion) interferes with the safe or effective operation of the Event.

9.3 We may reject any Event attendee that breaches this clause 9 and we shall not be liable to any refund or compensation.

10. FORCE MAJEURE

10.1 We are not liable for any delay or failure to perform these Terms (including hosting the Event) to the extent such delay or failure is caused by any Force Majeure Event. For the purposes of these Terms, "Force Majeure Event" means any circumstance outside of our reasonable control, and includes the following:

(a) acts of God, flood, drought, earthquake or other natural disaster;

(b) epidemic or pandemic;

(c) terrorist attack, civil war, civil commotion or riots, war, threat of or preparation for war, armed conflict, imposition of sanctions, embargo, or breaking off of diplomatic relations;

(d) any law or any action taken by a government or public authority;

(e) collapse of buildings, fire, explosion or accident;

(f) any labour or trade dispute, strikes, industrial action or lockouts;

(g) non-performance by suppliers or subcontractors;

(h) interruption or failure of any utility or public transportation service in Hong Kong;

(i) any event outside of our control that has an adverse effect on the Event, including:

           (i)          any public demonstration or protests; or

           (ii)         any governmental action that has a material adverse effect on the Event; and

(j) any other circumstance outside of the Organiser's control that leads the Organiser to believe (acting reasonably) that the Event cannot be safely or effectively hosted, or where significant changes would need to be made to the Event in order for it to be hosted.

11. GENERAL

11.1 We may assign any of our rights and obligations under these Terms to any third party.

11.2 These Terms are governed by Hong Kong law, and any disputes arising out of these Terms are subject to the exclusive jurisdiction of the Hong Kong Courts.

InvestHK and FINNOVASIA Limited are committed to ensuring that all personal data provided under various applications and notifications are handled in accordance with the relevant provisions of the Personal Data (Privacy) Ordinance. ​

Personal data collected and held

In order to provide a better service to you, we may collect information when you attend our functions, use our services, register with us or communicate with us. The typical types of information held by InvestHK and/or Finnovasia are basic contact details (such as name, job title, company name, address, email, travel document details, telephone and fax numbers), a record of our contact with you and your areas of interest e.g. sectors, events, publications etc.

Purposes of collecting and keeping personal data

The main purposes for which personal data are kept and used by InvestHK and / Finnovasia include:

– To provide services or information about Hong Kong FinTech Week To provide services or information to facilitate companies to set up or expand their business operation in Hong Kong

– To mail communications, publications, invitations and such like as you may select, request or as we may consider being relevant to you

– To measure the success of specific campaigns and for general market research; and for registration for events.

We may conduct direct marketing via fax, email, direct mail, telephone and other means of communication whether now or hereafter know, or send e-newsletters to you. You may choose not to receive promotional materials, by simply telling us (see below for contact details), and we will cease to do so, without charge. If applicable law required that we receive your explicit consent before we send you certain types of marketing communications, we will only send you those types of communications after receiving your explicit consent.

Privacy of personal data

Our website uses cookies to help us gauge what information is most useful to which users and such like. Cookies, however, keep the identity of our individual website users anonymous.

The data collected will be kept confidential. InvestHK and FINNOVASIA Limited will not divulge or sell personal details to external parties for their own purpose. InvestHK and/or FINNOVASIA Limited may, however, provide contact information to:

– Agents, contractors and personnel who provide services to InvestHK and/or FINNOVASIA Limited (for example, to those agencies engaged by InvestHK and /or FINNOVASIA Limited to administer the distribution of materials); and

– companies and clients of InvestHK and/ or FINNOVASIA Limited requiring information of service providers.

Security and retention of personal data

Only authorised people have access to, custody of and the means of using personal data InvestHK and Finnovasia collects. InvestHK and Finnovasia promote a privacy-aware culture that respects and is sensitive to the rights of its external contacts. ​ Data captured on-line or via this website (www.fintechweek.hk) retained with InvestHK and Finnovasia. Storage of your data with InvestHK and Finnovasia is protected in accordance with the requirements of the Government of the Hong Kong Special Administrative Region which protect against unauthorised or accidental access, processing, erasure or other use. ​ InvestHK and/or Finnovasia retain personal data so long as the data are still required for the purposes mentioned above. ​

An individual may request access to his personal data held by InvestHK and/or Finnovasia pursuant to the Personal Data (Privacy) Ordinance. A charge may be imposed to cover the cost of photocopying personal data at the rate as approved by the Secretary for Financial Services and the Treasury. In addition, an individual may also request for correction of his personal data held by InvestHK and/or Finnovasia if he considers the data are inaccurate.

Under the Hong Kong Personal Data (Privacy) Ordinance, you have the right: - to check whether we hold personal data about you and to access such data

  • to require us to correct inaccurate data

  • to ascertain our policies and practices in relation to personal data and the kind of personal held by us. ​ If you are in an EU Member State, subject to certain limitation and/or restrictions, you have the right under the data protection laws in the EU:
