Event Terms & Conditions

Summary

Everyone participating in any event organized by Prezi is required to agree to the following General Terms & Conditions. This includes all attendees, speakers, sponsors, volunteers or other participants. Briefly these terms cover how you can register, withdraw, attend the Conference and also how we manage and operate to ensure your participation. We encourage you to read the terms and contact us in case you have questions.

General Terms & Conditions

Prezi.com Korlátolt Felelősségű Társaság (seat: 1065 Budapest, Nagymező utca 54-56, Hungary; company registration number: 01-09-897644; tax number: 14298329-2-42; hereinafter referred to as “Prezi” or “we”, “us”, “our”) is a limited liability company registered by the Court of Registration of the Metropolitan Court in accordance with the effective Hungarian laws.

These are the General Terms and Conditions (hereinafter referred to as “GTC”) and Code of Conduct apply to all conference, workshops and events managed, planned, organized or provided by Prezi, including “Craft”, “Crunch”, “Amuse”, “Impact” and “Stretch” (hereinafter referred to as “Conference”) as well as related services.

Such services include the operation of Conference websites and their related subdomains including those pertaining to registration for attendance at the Conference and to be a volunteer at the Conference; the Conference apps; the workshops; online surveys relating to the Conference; operation of the Conference official social media channels, either free of charge or for consideration provided by Prezi or its contracted partners in relation to the Conference or other services which might be offered by Prezi in relation to the Conferences from time to time. For the purposes of this GTC, reference to the Conference will include related services as well, unless separately purchased by the Attendees. By registering to and/or attending a Conference all attendees, speakers, sponsors, volunteers or other participants (hereinafter collectively referred to as “Attendees”) agree to this following GTC and the Code of Conduct available at the particular Conference’s website.

The Contract

Prezi undertakes to ensure the participation of the Attendees on the Conference according to the provisions of this GTC and Attendees undertakes to pay the designated participation fees. With completing the registration and paying the participation fees the Attendees are eligible to attend the Conference. Prezi is entitled, at its own discretion, to use subcontractors and agents to organize and implement the Conferences.

Payments of the Fee

The Attendees shall register on the Conference ’s website, pay the dedicated fees of the tickets (unless the respective Attendee’s entrance is free of charge or complimentary) and accept the GTC and Code of Conduct. All bookings made prior to the Conference must be paid in full to guarantee registration. Once payment has been received, an email confirmation and a receipted invoice will be sent. The invoice will be sent within 2 (two) weeks after the registration. Payments should be made in advance and in USD only, using a debit or credit card, PayPal or via bank transfer. Tickets are only valid for the signed-up ticket holder and cannot be given to someone else during the Conference. Attendees may be requested to present registration confirmation/receipt or a valid ID document at the registration counter as proof of their registration and payment.

Early Bird Rate, Late Bird Rate, Diversity/Equality Rate and other Discounts

In order to be qualified for any “early bird” rates, booking and payment must be received before the deadline date listed in the Conference marketing material and on the website of the Conference. „Late bird” tickets are tickets with a higher price available only after the regular price tickets are no longer on sale. „Diversity/Equality” tickets are available for colleagues of different genders (e.g. a female and a male duo) according to the conditions presented in the Conference marketing material and on the website of the Conference. Other tickets and coupons with certain discounts may be applied to Attendees in line with the conditions presented in the marketing material and/or on the website of the Conference.

Hospitality Costs

On the Conference hospitality service such as food and drinks is provided by a third party contractor to all Attendees. The costs of hospitality service are included in the price of the tickets and listed as a mediated service in the final invoice.

Transferring and Refunding Tickets

Attendees may nominate an alternative person from their organisation to attend up to 2 weeks prior to the start of the Conference. Conference tickets are non-transferable afterwards, unless the ticket, the website or any marketing material of the respective Conference otherwise provides.

Attendees may request a full refund via e-mail for a period of 14 days after the creation of the final invoice of the tickets. After this 14-day period Attendees are still able to request a partial refund of the tickets of 65% of the participation fee, unless otherwise stated on the website, or marketing material or any specific terms and conditions of the respective Conferences.

There are no refunds on or after the Conference has started.

Alterations to Programme - Cancellation/Postponement of Conference

In case the Conference cannot be held or is postponed due to events beyond the control of Prezi or due to events which are not attributable to wrongful intent or gross negligence of Prezi, Prezi cannot be held liable by Attendees for any damages, costs, or losses incurred, such as transportation costs, accommodation costs, costs for additional orders, financial losses, etc.

Under these circumstances, Prezi reserves the right to either retain the entire registration fee and to credit it for a future conference, or to reimburse the Attendees.

Prezi reserves the right to modify the programme of the Conference. No refunds can be granted in case of cancellation of speakers, lack of space in the conference room or any other incidents during the Conference which are beyond the control of Prezi.

Photography & Filming

The Attendees’ participation in any Conference indicates the consent for the Attendees’ image to be recorded and used for publicizing the particular Conference as well as thank-you campaign purposes, including on social media. Images of Attendee might also be used to verify lawful entry procedure and participation in the Conference.

Liability and Safety

Attendees participates at the Conference at their own risk. Prezi excludes any liability toward Attendees except for (i) intentional breaches of contract (ii) breaches of contract damaging human life, (iii) physical or psychological well-being or (iv) health if such damages are caused by Prezi. Accordingly, Prezi excludes any liability under the Hungarian Civil Code with regard to any other kind of damages.

Attendees expressly acknowledge that in case tickets to a Conference is not purchased from Prezi, Prezi shall have no liability whatsoever against such Attendee. Notwithstanding that, this GTC and the Code of Conduct apply to all Attendees of a Conference.

During the Conference, the Attendees are entitled to use the existing visitor cloakrooms free of charge. Prezi shall assume no liability for the deposited items.

Attendees are required to abide by general norms and in accordance with relevant legal regulations, the GTC and with the given Code of Conduct of the Conferences. Attendees are required to refrain from all actions, statements or behaviour which endanger the life, health, physical or psychological well-being of others or which may violate others’ personal rights. Attendees are prohibited to enter the closed areas accessible from the Conference site.

Prezi will ensure enforcement of the rules of conduct and safety of the Conferences. Attandess expressly undertake, by virtue of their participation in the given Conference, to fully cooperate with Prezi within the bounds of the law and to follow instructions in the event of an emergency or if other important circumstances (for example reasons of public health) justify it. Prezi has the right to refuse access to or remove from the Conference any Attendees who violate this GTC and the Code of Conduct or do not cease such violation after having so requested by the organisers’ staff.

The Attendee states that the data that it has provided as being correct will be provided correctly when making purchases regarding the Conferences and on any other occasion when required for use related services. Prezi does not bear liability for damage resulting from incorrect or non-functioning data, email addresses or delivery addresses being provided, and may demand compensation for damage arising in this regard. The Attendee acknowledges that Prezi does not bear liability for any damage or abuse arising during or as a consequence of any payment method, or for the errors, failings or security of the payment method used. In the case of bank transfers, Prezi is not liable for the time taken for the transfer to be processed (with particular regard to banking holidays), or for damage arising from incorrect provision of the payee identifier or the transfer amount.

Pursuant to this GTC and Article 6:22 Paragraph (3) of the Hungarian Civil Code, claims arising from the legal relationship between Prezi and the Attendees may only be enforced within a six-months limitation period.

Personal Data Protection

By registering to and/or attending a Conference you accept and consent to that Prezi processes your personal data subject for the purpose of the Conference and in accordance with our Privacy Policy below and the applicable data protection laws.

General Provisions

All the advertising, promotional and hospitality rights in connection with the Conference are owned by Prezi. Any form of economic, commercial or advertising activity on the sites of the Conferences – including the area in front of the entry points of the Conference – without the prior written permission of Prezi is prohibited.

Prezi reserves the right to modify this GTC every now and then in order that accurately reflects legal requirements of Hungarian or EU law or the legitimate business interest of Prezi. Therefore we ask you to occasionally or prior to a Conference check this website and familiarize yourself with changes to the GTC which might occur from time to time.

In case of any conflict between this GTC and regulations set forth in the ticket & promoting materials for a Conference, the latter shall have priority over this GTC.

This GTC and any agreement derived from it shall be governed by the laws of Hungary.

The Attendees and Prezi stipulate that the ordinary courts of law competent as per the registered office of Prezi shall have sole jurisdiction with regard to any legal dispute concerning these GTC and Conference, without regard to conflict of laws regulations.

INTRODUCTION

Prezi.com Kft. (referred to as “we”, “us”, or “our” or “Prezi” in this Privacy Policy), organisers of conferences including “Craft”, “Crunch”, “Amuse”, “Impact” and “Stretch” (each, a “Conference”), is committed to protecting your personal information. We invite you to read this Privacy Policy, which explains the types of information collected and created in connection with the relevant Conference, how and why we use such information, who we share it with and your legal rights.

Unless indicated otherwise, this Privacy Policy relates to our use of any personal information we collect or use in relation to the following services (collectively, the “Services”): - the Conference; - the Conference websites and their related subdomains including those pertaining to registration for attendance at the Conference and to be a volunteer at the Conference; - the Conference apps; - the Workshops; - online surveys relating to the Conference; - the Conference official social media channels.

By providing us with your data, you warrant to us that you are over 13 years of age.

WHY WE COLLECT PERSONAL DATA?

We process and manage certain data in connection with the Services referred to in this Privacy Policy. This data may include personal data in the meaning of the applicable data protection laws. We will process the such personal data for the specific purpose of organizing and implementing Conferences and to provide certain Services, to contact and identify attendees, participants, contributors, sponsor or other interested parties. Registration and attendance to our Conferences requires the entering of certain personal data to verify the identity of the registered attendees and complete the registration to the respective event. By registering to the Conference you accept and consent to that Prezi processes your personal data subject to this Privacy Policy and the applicable data laws.

WHAT DATA DO WE COLLECT ABOUT YOU

Personal data means any information capable of identifying an individual. It does not include anonymised data.

We may process the following categories of personal data about you:

  • Communication Data that includes any communication that you send to us whether that be through the contact form on our website, through email, text, social media messaging, social media posting or any other communication. We process this data for the purposes of communicating with you, for record keeping and for the establishment, pursuance or defence of legal claims.

    Our lawful ground for this processing is our legitimate interests which in this case are to reply to communications sent to us, to keep records and to establish, pursue or defend legal claims as well as to comply with legal requirements of keeping business records.

  • Customer Data that includes data relating to any purchases of our Services such as your name, title, billing address, delivery address, email address, phone number, contact details, purchase details (including details of bank card or other payment method). We process this data to supply the Services and/or goods you have purchased and to keep records of such transactions for statutory legal.

    Our lawful ground for this processing is the performance of a contract between you and us and/or taking steps at your request to enter into such a contract as well as to comply with legal requirements of keeping our business records.

  • User Data that includes data about how you use any of our Services together with any data that you post for publication on our website or through other online Services. We process this data to operate our website and ensure relevant content is provided to you, to ensure the security of our website, to maintain back-ups of our website and/or databases and to enable publication and administration of our website, other online services and business.

    Our lawful ground for this processing is our legitimate interests which in this case are to enable us to properly administer our Services and to fulfill and contractual obligation we might have toward you in connection with the Services and the Conferences.

  • Speaker Data that includes data relating to any participation as a speaker the Conferences such as your name, title, address, delivery address, email address, phone number, contact details, purchase details (including your bank card details of bank card or other payment method). We process this data to keep contact with you, organize and promote the Conference, coordinate and purchase travel services and to keep records of such transactions.

    Our lawful ground for this processing is the performance of an agreement between you and us and/or taking steps at your request to enter into such an agreement as well as our contractual obligation to you and third party participants to hold the Conferences.

  • Technical Data that includes data about your use of our Services such as your IP address, your login data, details about your browser, length of visit to pages on our website, page views and navigation paths, details about the number of times you use our Services, time zone settings and other technology on the devices you use to access our Services. The source of this data is from our analytics tracking system. We process this data to analyze your use of our Services, to administer and protect our business and website, to deliver relevant website content and advertisements to you and to understand the effectiveness of our advertising.

    Our lawful ground for this processing is our legitimate interests which in this case are to enable us to properly administer our website and our business for our daily operation. Such data in most cases are anonymous information used for statistical purposes.

  • Marketing Data that includes data about your preferences in receiving marketing from us and our third parties and your communication preferences. We process this data to enable you to partake in our promotions such as competitions, prize draws and free give-aways, to deliver relevant website content and advertisements to you and measure or understand the effectiveness of this advertising.

    Our lawful ground for this processing is either your consent or our legitimate interests which in this case are to study how customers use our products/services and be able to organize further Conferences and provide related Services for the widest audience that may be interested.

  • We may use Customer Data, User Data, Technical Data and Marketing Data to deliver relevant website content and advertisements to you (including Facebook adverts or other display advertisements) and to measure or understand the effectiveness of the advertising we serve you. Our lawful ground for this processing is legitimate interests which is to grow our business. We may also use such data to send other marketing communications to you. Our lawful ground for this processing is either consent or legitimate interests (namely to grow our business).

Where we are required to collect personal data by law, or under the terms of the contract between us and you do not provide us with that data when requested, we may not be able to perform the contract (for example, to deliver goods or services to you). If you don’t provide us with the requested data, we may have to cancel the Services you have ordered or we may be unable to ensure your participation in a Conference, but if we have to, we will notify you at the time.

We will only use your personal data for a purpose it was collected for or a reasonably compatible purpose if necessary. For more information on this please email us at conf-data-protection@prezi.com. In case we need to use your details for an unrelated new purpose we will let you know and explain the legal grounds for processing.

We may process your personal data without your knowledge or consent where this is required or permitted by law.

We do not carry out automated decision making or any type of automated profiling.

HOW WE COLLECT YOUR PERSONAL DATA

We may collect data about you by you providing the data directly to us (for example by filling in forms on our site or by sending us emails). We may automatically collect certain data from you as you use our website by using cookies and similar technologies. Please see our cookie policy for more details on the website of the Conference.

We may receive data from third parties such as analytics providers such as Google based outside the EU, advertising networks such as Facebook based outside the EU, search information providers such as Google based outside the EU, e-mail marketing platforms such as Mailchimp based outside the EU, providers of technical, payment and delivery services, such as data brokers or aggregators.

BADGE SCANNING BY SPONSORS

Our events are sponsored by other companies (hereinafter ‘Sponsors’). Sponsors at our events may wish to scan your badge (QR-scan) so they can contact you with more information. Prezi uses the software tool of Compoffice-R Kft. (hereinafter ‘Compoffice-R’) to provide badge scanning services to Sponsors who request it.

By allowing a Sponsor to scan your badge you are consenting to have Compoffice-R provide the sponsor with your contact information, and thereafter you may be contacted by the sponsor post-event. If you do not wish the sponsor to contact you, please communicate this directly with the sponsor at the event or thereafter.

MARKETING COMMUNICATIONS

Our lawful ground of processing your personal data to send you marketing communications is either your consent or our legitimate interests, namely to be able to organize further Conferences and provide related Services for the widest audience that may be interested.

Accordingly, we will consider you as someone who might be interested in our Conferences and related Services, and may send you marketing communications from us if (i) you made a purchase or asked for information from us about our Services or (ii) registered to or participated in one of our Conferences (iii) or you agreed to receive marketing communications and in each case you have not opted out of receiving such communications since.

Before we share your personal data with any third party for their own marketing purposes we will get your express consent.

You can ask us or third parties to stop sending you marketing messages at any time by following the opt-out links on any marketing message sent to you or by emailing us at conf-data-protection@prezi.com at any time.

If you opted out we will stop sending any marketing communications and we will stop processing your personal data for such purpose.

If you opted out of receiving marketing communications this opt-out does not apply to personal data provided as a result of other transactions, such as purchases, warranty registrations etc, nor does it apply to processing or personal data on other legitimate legal grounds.

DISCLOSURES OF YOUR PERSONAL DATA

We may have to share your personal data with the parties set out below: - Other companies in our group who provide services to us. - Service providers who provide IT and system administration services. - Professional advisers including lawyers, bankers, auditors and insurers. - Government bodies that require us to report processing activities. - Third parties to whom we sell, transfer, or merge parts of our business or our assets.

We require all third parties to whom we transfer your data to respect the security of your personal data and to treat it in accordance with the law. We only allow such third parties to process your personal data for specified purposes and in accordance with our instructions.

INTERNATIONAL TRANSFERS

We share your personal data within our group of companies which involves transferring your data outside the European Economic Area (EEA).

We are subject to the provisions of the General Data Protection Regulations that protect your personal data. Where we transfer your data to third parties outside of the EEA, we will ensure that certain safeguards are in place to ensure a similar degree of security for your personal data. As such:

  • We may transfer your personal data to countries that the European Commission have approved as providing an adequate level of protection for personal data by; or
  • If we use US-based providers that are part of EU-US Privacy Shield, we may transfer data to them, as they have equivalent safeguards in place; or
  • Where we use certain service providers who are established outside of the EEA, we may use specific contracts or codes of conduct or certification mechanisms approved by the European Commission which give personal data the same protection it has in Europe.

If none of the above safeguards is available, we may request your explicit consent to the specific transfer. You will have the right to withdraw this consent at any time.

DATA SECURITY

We have put in place security measures to prevent your personal data from being accidentally lost, used, altered, disclosed, or accessed without authorization. We also allow access to your personal data only to those employees and partners who have a business need to know such data. They will only process your personal data on our instructions and they must keep it confidential.

We have procedures in place to deal with any suspected personal data breach and will notify you and any applicable regulator of a breach if we are legally required to.

DATA RETENTION

We will only retain your personal data for as long as necessary to fulfil the purposes we collected it for, including for the purposes of satisfying any legal, accounting, or reporting requirements.

When deciding what the correct time is to keep the data for we look at its amount, nature and sensitivity, potential risk of harm from unauthorized use or disclosure, the processing purposes, if these can be achieved by other means and legal requirements.

Generally, we store personal data for up to five years after the completion of any legal relationship with the data subjects. Following the end of this period, all personal data not to be stored and processed any longer due to mandatory law, will be erased and/or anonymized so that no links between the private individual data subjects and the anonymized are further traceable or identifiable. Amount of anonymized data shall be kept at the minimum and processed for the purpose of statistical and reporting purposes only.

If judicial (including arbitration) or other administrative claim or dispute arose, the term of processing the concerning the personal data shall be prolonged until the final and binding closing of the process. If extra-judicial contingent claim arose or threatened to arose, the term of processing the concerned personal data shall be prolonged until in accordance with the statute of limitation period for civil law damages (generally five years under local civil law).

For tax purposes the law requires us to keep basic information about our customers (including Contact, Identity, Financial and Transaction Data) for ten years after they stop being customers.

In some circumstances we may anonymize your personal data for research or statistical purposes in which case we may use this information indefinitely without further notice to you.

YOUR LEGAL RIGHTS

Under data protection laws you have rights in relation to your personal data that include the right to request access, correction, erasure, restriction, transfer, to object to processing, to portability of data and (where the lawful ground of processing is consent) to withdraw consent.

If you wish to exercise any of the rights set out above or have any complaints or issues about our personal data handling, please email us at conf-data-protection@prezi.com.

You will not have to pay a fee to access your personal data (or to exercise any of the other rights). However, we may charge a reasonable fee if your request is clearly unfounded, repetitive or excessive or refuse to comply with your request in these circumstances.

We may need to request specific information from you to help us confirm your identity and ensure your right to access your personal data (or to exercise any of your other rights). This is a security measure to ensure that personal data is not disclosed to any person who has no right to receive it. We may also contact you to ask you for further information in relation to your request to speed up our response.

We try to respond to all legitimate requests within one month. Occasionally it may take us longer than a month if your request is particularly complex or you have made a number of requests. In this case, we will notify you.

In the event of an infringement of your rights related to the processing of personal data, you may also turn to the Hungarian Authority for Data Protection and the Freedom of Information (1530, Budapest, Pf. 5.; e-mail: ugyfelszolgalat@naih.hu, web: www.naih.hu) or your local data protection authority within the EU or a competent court of law.
